Due to probability, sometimes an event is more likely to occur than we believe it to. In this case, if you survey a random group of just 23 people there is actually about a 50?50 chance that two of them will have the same birthday. This is known as the birthday paradox. Don't believe it's true? You can test it and see mathematical probability in action!

Background
The birthday paradox, also known as the birthday problem, states that in a random group of 23 people, there is about a 50 percent chance that two people have the same birthday. Is this really true? There are multiple reasons why this seems like a paradox. One is that when in a room with 22 other people, if a person compares his or her birthday with the birthdays of the other people it would make for only 22 comparisons?only 22 chances for people to share the same birthday.

But when all 23 birthdays are compared against each other, it makes for much more than 22 comparisons. How much more? Well, the first person has 22 comparisons to make, but the second person was already compared to the first person, so there are only 21 comparisons to make. The third person then has 20 comparisons, the fourth person has 19 and so on. If you add up all possible comparisons (22 + 21 + 20 + 19 + ? +1) the sum is 253 comparisons, or combinations. Consequently, each group of 23 people involves 253 comparisons, or 253 chances for matching birthdays.

??? ?Collect birthdays for random groups of 23 or more people. Ideally you should get 10 to 12 groups of 23 or more people so you have enough different groups to compare. (You don't need the year for the birthdays, just the month and day.)
??? ?Tip: Here are a few ways that you can find a number of randomly grouped people: Ask school teachers to pass a list around each of their classes to collect the birthdays for students in the class (most schools have around 25 students in a class); use the birthdays of players on major league baseball teams (this information can easily be found on the Internet); or use the birthdays of other random people using online sources.

Guest Blogger Kathleen Boozang: A New Insurance Product: Responsible Corporate Officer Defense Insurance

Unsurprisingly, the market has responded to the new risks corporate officials in the life sciences industry face if their companies commit crimes that threaten the public?s health.? On February 7, 2012 insurance broker Marsh USA and insurer Allied Assurance Co. unveiled a new product, called RCO Corporate Response, ?which provides insurance coverage for pharmaceutical, life sciences, and health care corporate officers who may be held liable for their companies? actions under the Responsible Corporate Officer (RCO) doctrine.??

For those who are rusty, The Responsible Corporate Officer Doctrine allows for the conviction of a high-level corporate official (ambiguity of terminology suggests that directors could be liable as well) whose company has violated the Food, Drug and Cosmetic Act irrespective of the official?s knowledge or involvement in the offense if the individual occupied a position that had a relationship with the unit that violated the statute, should have known about the activity, and had the authority to intervene. In short, the government need not produce evidence that the corporate official participated in or was aware of the illegal conduct. Potential penalties include fines, imprisonment, and debarment from the FDA.? As shall be discussed further, these penalties can lead to exclusion from Federal healthcare programs.

The Doctrine, which was first articulated by the Supreme Court in U.S. v. Dotterweich in 1943, was affirmed in 1975 in U.S. v. Park (and so sometimes referred to as the Park Doctrine).? The Dotterweich Court expounded on the rationale for imposing such a hardship on corporate defendants not actually involved in the illegal conduct: the welfare of unwitting consumers who have no ability to protect themselves against dangerous products and services must prevail over the hardship the Doctrine creates for the corporate executive with the position, responsibility and power to protect the public. The Park Court emphasized that guilt was not based solely on the defendant?s corporate position and explicitly recognized an affirmative defense where the defendant is ?powerless to prevent or correct the violation.?

The Doctrine has been rarely used, so fast forward to 2007, when the corporate entity Purdue Frederick pled guilty to a felony of misbranding along with the CEO, Chief Medical Officer and Chief Legal Officer who plead to misdemeanor misbranding pursuant to the Responsible Corporate Officer Doctrine. The convictions arose from Purdue Pharma?s off-label promotion of OxyContin, which the FDA approved in 1995 to manage chronic moderate to severe pain.? From 1995 until 2001, contrary to the package insert and evidence on the ground, a number of Purdue employees promoted OxyContin ?as less addictive, less subject to abuse and diversion, and less likely to cause tolerance and withdrawal,? as subject to fewer peak and trough blood level effects, and producing less euphoria than other pain short-action opioids. These representations apparently occurred in some instances at supervisors? urging, or as a result of sales training.

OxyContin became the number one prescribed Schedule II narcotic in the United States, with 5.8 million prescriptions in 2000.? OxyContin revenues reached approximately $3 billion in June 2001, accounting for 80% of Purdue Pharma?s revenue.? Despite its various troubles with OxyContin, Purdue Pharma never saw a dip in its revenues.? Effective August 9, 2010, Purdue discontinued manufacturing and distributing the original formulation, replacing it with an FDA-approved reformulation that is apparently more difficult for abusers to penetrate by cutting, breaking, crushing or dissolving.

OxyContin is an effective and efficient analgesic.? In addition to its legitimate use, however, OxyContin became very popular as a street drug, either taken orally, injected, or crushed, which circumvented the controlled release mechanism and allowed a more rapid and intense heroin-like high.?? The legal complications began when Appalachia experienced particular challenges with Oxy diversion, leading to criminal charges by the U.S. Attorney for West Virginia against what appears to have essentially been a shell corporation, Frederick Purdue, as well as three senior corporate officers.? Notably, Purdue Parma, L.P. which is the corporate entity that actually sells OxyContin as well as the company?s other pain medications, was not charged, thereby enabling it to continue to submit drug applications to the FDA and have its products paid for by the Federal healthcare programs.? Frederick Purdue and its executives agreed to plead guilty and pay fines totaling $634,515,475. Almost immediately, the HHS OIG used its discretionary exclusion power to debar all three executives from participating in Federal healthcare programs for twelve years.? The executives were unsuccessful in every level of administrative and judicial appeal. In retrospect, the Purdue Parma execs may feel relieved after hearing that three Synthes executives received multi-month prison terms in addition to their fines pursuant to the RCO Doctrine for their company?s conduct of unauthorized clinical trials of bone cement in which three patients died.

On the heels of this success, the FDA announced that it was increasing its use of misdemeanor prosecutions against responsible corporate officials.? The agency unveiled its internal agency guidance for determining when to forward a case to the Department of Justice for a "Park Doctrine Prosecution".? The guidance provides that a first time conviction for a violation of the FDCA will be a misdemeanor, with the second resulting in a felony.? Further, some misdemeanor convictions can result in debarment by the FDA.? Most importantly for this discussion, the guidance states that ?Knowledge of and actual participation in the violation are not a prerequisite to a misdemeanor prosecution but are factors that may be relevant when deciding whether to recommend charging a misdemeanor violation.?? The guidance enumerates the following additional criteria:

• The individual?s position in the company; relationship to the violation; whether the official had the authority to correct or prevent the violation
• Actual or potential harm to the public
• Obviousness of the violation
• Existence of a pattern of illegal behavior and/or failure to heed prior warnings
• Whether the violation is widespread
• Seriousness of the violation
• Quality of the legal and factual support for the proposed prosecution
• Whether prosecution is a prudent use of agency resources

Within the same week, Lewis Morris, Chief Counsel to the Inspector General of Health & Human Services testified before the House Ways and Means Committee that the OIG would review the case of any individual convicted pursuant to the RCO Doctrine for exclusion from participation in Federal healthcare programs.? This, Mr. Morris testified, will overcome the barriers presented by corporations? attitude that they are too important to the healthcare system to criminally prosecute and that fines are simply a cost of doing business.?? Mr. Morris assured the House Committee that the OIG would use this tool judiciously, employing a presumption in favor of exclusion only ?when there is evidence that an executive knew or should have known of the underlying criminal misconduct of the organization.?? The HHS OIG criteria for permissive exclusions from Federal healthcare programs includes a consideration of the entity?s misconduct, including whether it is part of a pattern of conduct and whether it caused harm to beneficiaries; the individual?s role in the sanctioned entity with a focus on degree of managerial control or authority and the position?s relation to the underlying misconduct and whether the misconduct occurred in the individual?s chain of command; and finally, detailed information about the nature of the sanctioned entity including its size, revenues, organization and structure.??

With this background, one wonders how the new RCO insurance policy would work in these cases????

The benefits of the policy include coverage for:

• Defense costs incurred in the investigation or defense of any misdemeanor criminal proceeding, administrative proceedings brought pursuant to the RCO doctrine, as well as debarment proceedings.
• Defense cost coverage for potential RCO claims.
• Lost future compensation resulting from exclusion/debarment.
• ?Recoupment loss? and/or clawback awards, which is the value of any compensation that must be returned or repaid by an insured person as a result of a judgment, decision, or settlement of an RCO claim.

An obvious omission from this list of benefits is the actual fines that are levied as part of the conviction, which are generally in the hundreds of millions. This is undoubtedly because insuring such risk would be against public policy.? Not mentioned on the web site, but revealed in an interview with the Philadelphia Inquirer is that policy exclusions ?might? kick in if evidence exists that the insured engaged in affirmative conduct that resulted in conviction. PharmaLot uncovered the same caveat in its interview with Jack Flug, a managing director at Marsh:? ?If the government decided the target knew what was going on and intentionally did something wrong, the coverage would cease. The intent factor is critical.?? Again, maybe dictated by public policy concerns.

But how will this work in practice?? Recall that the FDA?s Park Doctrine guidelines ? ?Knowledge of and actual participation in the violation are not a prerequisite to a misdemeanor prosecution but are factors that may be relevant when deciding whether to recommend charging a misdemeanor violation.?? DOJ will employ a presumption in favor of exclusion only ?when there is evidence that an executive knew or should have known of the underlying criminal misconduct of the organization.??? These criteria raise questions of just how the insurance company is going to ferret out evidence of intent, or whether it will use the language of these two government agencies to create its own presumption that intent exists once a conviction occurs, unless the insured can prove otherwise. Ultimately, there?s a real question of just how many payouts will actually be made under these new RCO policies.?

Another question, obviously, is whether prosecutors engaged in settlement negotiations will allow these insurance policies to be invoked.? U.S. v. Stein, the 2008 opinion in which the Second Circuit held that prosecutors? threat to indict KPMG if it paid its employees? legal fees violated the employees? Sixth Amendment rights to assistance of counsel, sheds one possible perspective on the outcome of this question.

Finally, the Marsh?s policy description does not mention covering directors, though one would have to imagine it would be willing to sell such a policy if so requested.? While it has yet to happen, , given their aggressive stance, that the FDA and OIG would not miss the opportunity, with the right facts, to? pursue the Responsible Officer Doctrine against a board member, perhaps on the Audit Committee.

A final twist: according to the Inquirer, upon learning of the new policy, Secretary of Health & Human Services Kathleen Sebelius replied, "I don't practice law on a regular basis, but usually you can't insure yourself as a bank robber for robbing banks. That is intriguing. I'd like a list of their customers because that would give us a pretty good target of people to go after."

Freshwater fish and living conditions, are we doing too much? | Pets ...

Hello,
My question is with regards to fish and conditions of living. I have always been intrigued by the living conditions that pet shop provide to freshwater fish on sale. I?m not a resident of the United States. Pet shops in my country provide the minimum acceptable living conditions to their fish, no soaking of pellets before feeding, water changes only once a month and overstocked and dirty aquarium. Yet, I?ve observed that all the different varieties of fish even the supposedly more sensitive ones such as dicus which requires clean water stay in good health for a long time. I mean they look healthy, their fins are not clamped etc. We aquarists have always been taught that we should do regular weekly water changes and take many steps to keep our goldfish healthy and prevent diseases. So how come, the goldfish at the pet store apparently do not get sick for such a long time.

In spite I try as far as I can to provide good living conditions for my goldfish, they always get sick. The fish I bought got sick, I tried to cure it but in vain. I don?t understand where the problem is, should I perform less water changes as the pet shop.

Are we exaggerating when we strive to provide optimum water conditions to our pet fish and thereby diminishing their resistance to pathogens.

What you perceive as optimal living conditions may not be in line with is actually needed..

No biggie, sometimes we tend to over care for our fish not realizing it? s hurting them?

If you give the fish the proper size home, use a filter, don;?t overstock the tank, under feed and do no more than 15-20% water changes weekly there is no chance of a fish dieing on on you.

as well you may want to change where you buy fish..

there fish could be very inbred and genetically flawed and doomed to die early?

that would not be your fault then would it??.

BAMAKO, Mali (AP) ? Soldiers stormed the presidential palace of one of the few established democracies in this corner of Africa and announced Thursday that they had seized control of the country, ousting Mali's president just one month before he was due to step down at the end of his legal term.

Gunfire could be heard ringing throughout the capital, and the mutinous soldiers imposed a nationwide curfew, warning people to stay off the streets until further notice. A flight headed to the capital of Bamako was forced to make a U-turn in the air after the airport closed.

The soldiers said they are overthrowing the government because of its mishandling of an ethnic Tuareg insurgency in the country's north that began in mid-January. The rebellion grew when fighters who had supported the late Libyan leader Moammar Gadhafi returned home heavily armed. The unrest has forced tens of thousands to flee, and has prompted fierce criticism of Mali's government.

Early Thursday, a group of around 20 soldiers in military fatigues were shown on national television crowding around a desk, facing the camera.

They announced that Mali is now under the control of the military's National Committee for the Reestablishment of Democracy and the Restoration of the State, or CNRDR. They said they were suspending Mali's constitution and dissolving its institutions.

The soldiers complained that the civilian government had not done enough to combat a rebellion by the ethnic Tuareg separatists, who want to carve out a homeland in the country's northern desert.

"The CNRDR representing all the elements of the armed forces, defensive forces and security forces has decided to assume its responsibilities and end the incompetent and disavowed regime of (President) Amadou Toumani Toure," they said, reading from a statement. "The objective of the CNRDR does not in any way aim to confiscate power, and we solemnly swear to return power to a democratically elected president as soon as national unity and territorial integrity are established."

The West African regional bloc ECOWAS said it "strongly condemns the misguided actions of the mutineers." The group said it was "all the more reprehensible, coming amidst the ongoing regional and international efforts to seek a peaceful solution to the rebellion in the north of the country."

The soldiers' declaration also came just hours after the presidential palace had rushed to deny that a coup was in progress, issuing a Tweet that said: "There is no coup in Mali. There's just a mutiny."

The latest developments mark a major setback for one of the region's few established democracies. The ousted president came to power himself in a 1991 coup, but was hailed for handing power to civilians. A decade later, he won the 2002 democratic election. The 63-year-old Toure was due to step down next month after two, five-year terms.

His whereabouts were unknown on Thursday. Contacted by telephone, a soldier at the palace said that the president's bodyguards had failed to fight the renegade soldiers, who burst in. They searched the grounds looking for him, but could not find Toure.

Young soldiers on motorcycles were shooting in the air Thursday morning in the capital of Bamako. Businesses remained shuttered and there was little traffic as most stayed home following the coup announcement.

On Wednesday, Defense Minister Gen. Sadio Gassama had come to a military camp in the capital for an official visit but failed to address the grievances of the rank-and-file soldiers in his speech to the troops. The rebellion has claimed the lives of numerous soldiers, and those sent to fight say they are not given sufficient supplies, including arms or food.

Recruits started firing into the air Wednesday morning and by afternoon, troops had surrounded the state television station, yanking both the television and radio signals off the air for the rest of the day. By Wednesday evening, troops had started rioting at a military garrison located in the northern town of Gao, some 2,000 miles (3,200 kilometers) away.

A freelance journalist from Sweden who was driving to her hotel near the TV station in Bamako around 4 p.m. Wednesday said that trucks full of soldiers had surrounded the state broadcaster, where they set up machine guns facing the building.

"They came and started setting up checkpoints. There were military in the streets, stopping people," said Katarina Hoije. "When we reached our hotel which is just in front of the TV station, there were lots of military outside, and more cars kept arriving ? pickup trucks with soldiers on them."

The Tuaregs, a traditionally nomadic people spread across the Sahara Desert, have risen up against the central government in Mali several times since the country's independence from France in 1960.

The newest rebellion launched in mid-January broke years of relative peace, and has been fueled by the return of Tuaregs from Libya who had fought in Gadhafi's army. Refugees have spilled over into four of the countries neighboring Mali due to the uprising.

Thousands of Tuaregs moved from Mali to Libya over the decades beginning in the 1970s, and many joined special divisions of Gadhafi's military where they earned higher salaries than in Mali. A relationship developed between the Tuareg and Gadhafi, who claimed they had distant blood links.

When the Gadhafi regime fell last year, Tuareg troops smuggled Gadhafi family members to neighboring Algeria and Niger. After Gadhafi was killed in his hometown of Sirte in October, many Tuaregs no longer felt safe in Libya and began returning to Mali.

The government has not disclosed how many government soldiers have been killed. The toll is believed to be significant and in February, military widows led a protest, publicly grilling Toure on television over his handling of the rebellion.

Let me repeat that in case you did not get it:

If you are in sales management and wish to increase sales, stop looking to unsustainable solutions that focus on having a selling problem. For the selling problem is probably a symptom of a yet determined problem or worst yet one of those kick the can problems that just grow over time into that big ugly elephant that is suddenly discovered in the sales department.

Fact: People have been buying goods and services for untold thousands of years.

Fact: People are still people, still human beings.

Fact: Human nature has not essentially changed all that much since man or woman first bartered to exchange a Mammoth bone for some shiny shells.

BIGGER FACT: All this sales training coaching and consulting around we have a selling problem is just plain bogus.

This may sound somewhat hypocritical coming from someone who is viewed by some as a sales coach, a business coach, a continuous improvement process specialist or an executive organizational development consultant.? However it is not.

My belief and consequently my practice from day one has been all about the development of people to being better individuals rather than training them so they can be retrained in another 6 months to a year.

We train dogs.

We develop people.

Now what a small business to Fortune 100 firm may really have is:

• ?A people problem including self limiting attitudes and inconsistent behaviors
• An organizational problem where misalignment dilutes results (remember organizations are just a group or groups of people coming together to do more collectively than they could individually)
• A constrained potentially ulcerated culture mentality keeping small business owners, C suite executives to sales management from seeing the real problem
• Because it is much easier to point the finger, to shout and in some cases whine quite vocally:

We have a sales or selling problem!

And the worst offenders of this ?we have a selling problem? are those organizational development consultants, business coaches, executive coaches, sales coaches, business strategists, academic collegiate professors, call them what you may who sell solutions addressing this bogus problem. No wonder many small business owners to C Suite executives raise an eyebrow when it comes to hiring outside resources.

We need sales people, sales managers, bosses, business owners, C Suite executives to even front line workers with these interpersonal and intrapersonal talents:

• Handling rejection (Not letting ?No? derail daily productivity)
• Persistence (Think the Little Red Engine or Energizer Bunny)
• Persuading Others (Appreciating others through collaboration)
• Self confidence (The ability to take risks with a yes I can attitude)
• Self starting ability (Working alone without constant supervision)
• Diplomacy (The application of emotional intelligence)
• Realistic personal goal setting (Identifying both personal and professional within a written action plan)
• Long range planning (Proactive behavior instead of reactive behavior)
• Project and goal focus (Knowing where the predetermined results originate from)
• Seeing potential problems (Applying critical thinking skills)
• Quality orientation (Shabby work is not allowed)
• Attention to detail (Being aware of all the pieces to the puzzle)
• Concrete organization (Thinking realistically)
• Consistency and reliability (Doing what needs to be done each and every day)
• Personal accountability (No blame game mentality allowed)
• Self management? (Lead yourself first before you can lead others)
• Results orientation (The ability to focus on securing results)
• Relating to others (Being able to play nice in the sand box)

Why because:

Everyone is in sales!

The selling problem bogus mentality ignores everything else that is happening within the organization and may actually be the reason for the inability to:

• Increase sales
• Improve profitability
• Speed up productivity
• Build customer loyalty
• Secure a competitive advantage

However by addressing this bogus selling problem lines the pockets of business coaches, sales coaches, executive consultants even universities and is a source for repeat revenue.? Great business model, but quite unethical given the solutions are not sustainable.

I, for one, am so tired of this insanity still being alive in the world of sales and selling.

Isn?t it time we started to address the real problems facing organizations by taking a more holistic, aligned and balanced approach where emotional intelligence and self leadership work together with the organizational strategies (provided they have been developed and are regularly monitored)?? Until we change how we look at things, the things we look at will remain the same and this bogus issue of

?we have a selling problem?

will continue to drain the coffers, the innate desires, the essence of what makes every organization healthy and unique.
