Securities and Exchange Commission staffers left highly-sensitive information from stock exchanges open to hacking and cyber-attacks because they didn't adequately protect the security of some computers and other electronic devices, according to Reuters, citing people familiar with what happened.

Ex-Goldman trader accused of $118 million loss denies fraud

NEW YORK (Reuters) - A lawyer for a former Goldman Sachs Group Inc trader denied on Friday U.S. civil accusations that his client had defrauded the Wall Street bank of $118 million.

The trader, Matthew Marshall Taylor, was sued on Thursday in U.S. District Court in Manhattan by the Commodity Futures Trading Commission (CFTC) which said he had manually entered fake trades in November and December 2007, in an attempt to conceal an $8.3 billion position in futures contracts.

"Matt Taylor is disappointed the CFTC filed a complaint about trades in a Goldman proprietary account which took place five years ago," Ross Intelisano, Taylor's New York-based attorney, said in a statement to Reuters on Friday.

"He strenuously denies all of the allegations," the statement said. "Matt never intentionally entered 'fabricated trades' to conceal any trading activity and Goldman never alleged he did so at the time of his termination or thereafter."

The CFTC is seeking a $130,000 civil penalty against Taylor, who currently resides in Florida. The complaint said Taylor had concocted a scheme of fabricated trades and fake entries that ended up costing the bank $118.44 million.

The lawyer said it was Taylor himself who alerted his managers of the trading losses and not, as the complaint alleges, the other way around.

A Goldman Sachs spokeswoman said on Thursday that the bank had terminated Taylor's employment after his suspected conduct had been discovered, and that customer funds had not been affected.

After leaving Goldman, Taylor went on to work at Morgan Stanley , broker records showed. A Morgan Stanley spokesman said Taylor had left the bank in July.

The case is U.S. Commodity Futures Trading Commission v. Matthew Marshall Taylor, U.S. District Court for the Southern District of New York, No 12-cv-8170.

WisconsinNews reports from Sauk Center, Wisconsin, just north of Madison, a shipment of modular homes had a piece of Highway 12 paralyzed in the downtown area because there was not enough room to turn a corner. Sauk Center police were called to direct vehicles. MHProNews could not immediately determine who manufactured the homes or their destination.

(AP) ? China's ruling Communist Party opened a congress Thursday to usher in a new group of younger leaders faced with the challenging tasks of righting a flagging economy and meeting public calls for better government.

The weeklong congress starts a carefully choreographed but still fraught power transfer in which President Hu Jintao and most of the senior leadership will begin to relinquish office to a new slate of leaders for the coming decade headed by the appointed heir, Vice President Xi Jinping.

Delegates filed into Beijing's Great Hall of the People, bedecked with red banners, and the congress was declared open after the national anthem played. The 2,268 delegates are drawn from the 82 million-member party where the real deal-making is done by a few dozen power-brokers behind the scenes, even as China is ever more connected to the world through trade and the Internet.

"We are faced with unprecedented opportunities for developments as well as risks. The party must keep in mind the trust of the people," Hu said in a speech aimed at summarizing successes of the past five years and outlining challenges for the future. "The fight against corruption remains a serious challenge for us."

Coming so soon after President Barack Obama's re-election in the United States, the congress has drawn unfavorable comparisons from politically minded Chinese who have bemoaned how little direct influence they have in choosing their leaders.

"I am doing nothing but staring at the television before Obama gets re-elected. As for China's party congress, there is no need for me to worry. On the contrary, it would be a waste of my time," Xu Xiaoping, a celebrity entrepreneur who co-founded a successful chain of English language cram schools, said on a Chinese version of Twitter where he has 6 million followers.

To many Chinese, China is at an inflection point. Its old model of heavily state-directed growth that lifted hundreds of millions out of poverty and made China an economic powerhouse is sputtering in the face of rising domestic debt and a weak global economy. Meanwhile, the government has to contend with the public's continued expectations of higher living standards and for less corruption and greater accountability, if not outright democracy.

In Tiananmen Square, adjacent to the congress venue, a woman in her 30s threw pieces of torn paper into the air and shouted "bandits and robbers!" in the early morning before she was taken away by security forces.

On the eve of the congress, four ethnic Tibetans in Sichuan province set themselves on fire in protests against Chinese rule of Tibetan areas, London-based rights group Free Tibet said, adding that the timing of the protests appeared aimed at sending a signal to the Chinese leadership.

Whether the new leaders want to move China in a new direction is not known. Xi and other top candidates for the new leadership have forged their careers as capable administrators in provinces and bureaucracies, not as policy trail-blazers. Should ambitious change be on their agenda, they will have to confront vested interests within their ranks: cosseted state industries and conservative officials grown prosperous and powerful under the current system.

One thing the party appears to be ruling out is a major shift toward a more open, democratic political system, despite appeals in recent months from commentators, retired party members and government think tanks.

"The leading position of the Communist Party in China is a decision made by history and by the people," congress spokesman Cai Mingzhao told reporters on Wednesday. He pointed to China's rise as an economic power and said, "It speaks fully to the strong leadership of the Chinese Communist Party and the fact that the political system suits China's national reality."

The congress itself is unlikely to give Xi and his colleagues a mandate for sweeping reform. They have been engaged with Hu, retired party elders and influential senior politicians and military commanders in divisive bargaining, made worse by a pair of scandals. Politburo member Bo Xilai was purged after an aide disclosed that Bo's wife had murdered a British businessman. One of Hu's top lieutenants was also sidelined after his son died crashing a Ferrari, a sign of corruption.

A likely result of the back-and-forth is a leadership that balances interest groups, and over the past decade that has been a recipe for plodding, incremental policy.

Cai, the congress spokesman, ticked off a list of what Hu's team had accomplished ? wider access to state-supported education through the ninth grade, an expanded social safety net and the start of a nationwide low-cost housing sector.

"The past decade has witnessed the greatest improvement in people's livelihoods in the history of China's development," Cui said. "We will make guaranteeing and improving the people's well-being the guide and aim of what we do."

This proposed increase in regulations will have significant public health consequences, due to reduced access to early defibrillation for the nation's victims of sudden cardiac arrest. If regulatory hurdles increase, access to lifesaving treatment with AEDs will decrease. Following is our letter to the FDA.

A Letter from the Sudden Cardiac Arrest Foundation to the Food and Drug Administration:

Dear Sirs:

The Sudden Cardiac Arrest Foundation is a national nonprofit 501(c)(3) organization whose mission is ?to raise awareness and support programs that give ?ordinary people? the power to save a life."

We are writing to express our concern that the Food and Drug Administration is considering reclassification of automated external defibrillators (AEDs) as Class III Devices requiring pre-market approval. We believe that increased regulation of the user-friendly lifesaving devices?proven irrefutably safe and effective by decades of research?would demonstrate a lack of understanding about the life-threatening condition of sudden cardiac arrest and would have a profoundly harmful effect on unsuspecting victims, greatly reducing their chances of survival.

As you are certainly aware, sudden cardiac arrest is a leading cause of death in the U.S., affecting more than 1,000 people each day (382,500 people annually) and on average, only eight percent of victims survive. [1] Survival rates increase slightly when victims receive bystander CPR, however, survival rates increase dramatically to 38 percent when victims receive both CPR and treatment with AEDs by bystanders. If all SCA victims had timely access to treatment with AEDs and the average survival rate increased to 38 percent, more than 100,000 additional lives could be saved each year. [2]

We believe the FDA would be prudent to reconsider the proposed increase in regulations, and instead focus on ensuring that AEDs are widely deployed and the public is informed about the importance of using the lifesaving devices?without hesitation?in cases of sudden unexpected cardiac death. We urge the FDA to redirect its energy and resources to help raise awareness about the need for immediate bystander intervention with AEDs.

Our Sudden Cardiac Arrest Survivor Network is a testament to the fact that a quick combination of CPR and defibrillation is nothing less than the key to survival. Earlier this fall, we co-hosted a gathering of survivors from around the U.S., who would be quick to point out they owe their lives to the timely use of AEDs.

Perhaps our national spokesperson, TV news anchor and sudden cardiac arrest survivor, Susan Koeppen, 39, says it best: ?If it were not for the bystanders who rushed to help me, I would not be here today. I can?t stress enough the importance of learning CPR and how to use an AED.?

Robust AED safety and performance standards already exist that capture more than 20 years of hard-won clinical, regulatory, and industry experience.

We urge the FDA to consider alternative pathways that ensure the safety and effectiveness of AEDs, and at the same time support efforts to drive widespread access to early defibrillation.

It has taken decades to get this far. We cannot afford to decrease the odds that victims in need will have timely access to definitive care.

Early defibrillation is the definitive treatment for sudden cardiac arrest (SCA), which claims more than 300,000 lives in the United States per year. Widespread distribution of automated external defibrillators (AEDs) is overwhelmingly advocated by the medical community and legislators as a strategy for achieving early defibrillation. Even with the growing availability of AEDs in the US and highly successful early defibrillation programs throughout the country, the current national SCA survival rate is less than 8%, largely because without AEDs early defibrillation doesn?t happen in time. In order to improve the national survival rate and help restore more lives, we must continue to drive widespread access to AEDs.

It is my understanding that the FDA is considering classifying AEDs as class III, requiring pre-market approval (PMA). I am writing to express my concern that this increased regulation of AEDs will limit innovation and public access to these devices, both highly negative results. Over several decades, hundreds of peer-reviewed studies have already demonstrated that AEDs are safe and effective and that early defibrillation saves lives. There is no guarantee, and little likelihood that requiring AEDs to go through the PMA process will lead to an increase in AED safety and effectiveness. To the contrary, these additional regulations will likely stifle innovation and new, improved technology will be delayed, or may not even be pursued in the US due to regulatory costs and time-to-market considerations under the PMA process.

Furthermore, AEDs will become more expensive to purchase and maintain as a direct result of expenses associated with increased regulatory requirements. Communities, public entities such as schools and police forces, companies, including small businesses, and non-profit organizations, are among the primary groups that provide the funds to purchase and maintain public access AEDs for which there is no insurance reimbursement. Moreover, to the extent individuals can now afford to have AEDs in their homes, this additional source of AED availability will surely diminish or disappear altogether. As prices rise, fewer AEDs will be purchased and deployed which limits public access AED availability when they are critically needed to help save lives. Without public access AEDs the average time to defibrillation will likely increase, which then could decrease survival in the US associated with SCA.

Robust AED safety and performance standards already exist that capture over 20 years of hard-won clinical, regulatory, and industry experience. These AED-specific standards are the foundation for securing consistent performance as they drive implementation of best practices across the industry. Perhaps focusing on broader support and continuous improvement of these standards would help achieve even improved product performance, while maximizing access to life-saving AEDs.

I urge the FDA to consider alternative pathways that ensure the safety and effectiveness of AEDs, but at the same time continue to support efforts to drive widespread access to early defibrillation. For the hundreds of thousands of Americans who unexpectedly suffer an SCA each year, we cannot afford to further decrease the odds that an AED will be available when needed to help restore their lives.

Application Development Productivity ? You've Got to Be on the ...

The main indicator of productivity in application development (AD) ? periodic reduction in the number of application defects per 1000 lines of code written in X man hours ? has stood the test of time at a modular level, as have CMMI standard metrics against which any calculation of productivity can be benchmarked.

However, in the midst of mounting pressure to optimize discretionary IT spend, buyers have no option but to justify their spending via data that evaluates productivity at the enterprise level. CIOs must meet this requirement, while also facing the following two challenges:

  • First, they must simultaneously deliver increasing value and achieve year-on-year annual reduction in costs
  • Second, they have to contend with educated business users who may not have the patience to deal with a behemoth enterprise IT organization to get their functional needs fulfilled. Indeed, with the advent of market forces such as social media, mobility, analytics, and cloud (SMAC), business users today understand more about applications and technology than they ever did in the past

As a result, IT buyers must ignore all the ambient noise created by multiple metrics and focus only on the following two factors:

  • Business functions: The functionality that the business users are demanding, complete with SLAs
  • Application cost: The cost to acquire the applications that provide the required functions.

Fortunately for them, data indicates that ?business functions versus cost? can be useful in benchmarking the productivity of any application development project. ?As the following image illustrates, for AD projects of specified complexity and type, a combination of the number of functions (F) in an application and the cost (C) to acquire that application can be plotted into an ?indifference curve.? An indifference curve is a graph showing different bundles of two variables between which a consumer is indifferent. Basically, all points on the curve deliver the same level of utility (satisfaction) to the consumer.

Application Develop Productivity

Based on benchmarking data over many years, all points that form these indifference curves deliver an optimal level of productivity for the complexity specified.

This productivity benchmarking can be used to assess and optimize the productivity of AD projects. For instance, if a particular AD project, for example application 3 in the above image, falls below its indifference curve, it is delivering sub-optimal productivity. Thus, by using this method of benchmarking, a buyer can immediately raise a flag with its service provider and force it to either:

  • Reduce costs to achieve optimal productivity, or
  • Provide more functionality to align the project with productivity indifference curve

This benchmarking tool also delivers benefits to service providers. If their case in point AD project is application 1, which falls above the indifference curve, they: 1) have consumer surplus into which they can dig (i.e., buyers could be willing to more); and 2) can use the data to advertise their higher productivity performance to generate more business and differentiate themselves from their competition.

On Monday evening,?Jackie Kimzey, executive director of The Institute for Innovation and Entrepreneurship at UT Dallas, sent an email to supporters asking for sponsorship money for its annual Business Idea Competition.

By early this morning, the institute?s assistant director Nancy Hong received good news. Someone was stepping up and providing the necessary $20,000 for prices?and awards for the winning teams.

The sponsor was no other than Mark Cuban. Contacted via Twitter, Cuban confirmed the donation and said, ?Happy to be part of it!?

?Mark is obviously a great entrepreneur and good businessman, and he has a real heart not only for the community but for entrepreneurs,? Kimzey said, noting that people could still give. ?I was surprised but I wasn?t.

The Mavericks owner knows a thing or two about business competitions. He?s a judge on ABC?s Shark Tank, which gives budding entrepreneurs an opportunity to sell their products or ideas. ?Sharks? like Cuban can invest their own money to help fund these entrepreneurs.

In 2009, Cuban, who founded HDNET, spoke at UT Dallas as part of Entrepreneurship Exchange, a speaker series hosted by the campus Entrepreneurship Club and the institute.

As for the Business Idea Competition, the UT Dallas faculty has evaluated interested teams and have narrowed the field to 12 undergraduate and 12 graduate teams, Kimzey said. Staff is now coaching the students for their final presentations before outside judges on Nov. 16.

First place winners in each division will receive $5,000 a piece. Second place is $2,500; third place $1,500 and fourth place $1,000.
